General Terms of Service

Please read these terms of service (“terms”, “terms of service”) carefully before using www.breadsticc.art website (the “service”) operated by Breadsticc Art (“me”, “myself”, “I”, “my”).

Conditions of Use

I will provide my services to you, which are subject to the conditions stated below in this document. Every time you visit this website, use its services or make a purchase, you accept the following conditions. You may amend these conditions in the event that the changes are discussed and agreed upon in writing by you and Breadsticc Art. You must be 18 years or older to order any product or service from this website.

Copyright

Content published on this website (digital downloads, images, texts, graphics, logos) is the property of Breadsticc Art and/or its content creators and protected by international copyright laws. The entire compilation of the content found on this website (with exceptions for content for which express written permission to use is given by its respective owner) is the exclusive property of Breadsticc Art. You may not commercially exploit, rent, transfer, assign, resell, or sublicense access to the content, media, products or services provided by Breadsticc Art.

Communications

The entire communication with me is electronic. Every time you send me an email or visit my website, you are going to be communicating with me. You hereby consent to receive communications from me. You also agree that you are at least 18 years of age before initiating communications with me, and that you will not contact me prior to turning 18.

Applicable Law

By visiting this website, you agree that the laws of the United States of America, without regard to principles of conflict laws, will govern these terms of service, or any dispute of any sort that might come between Breadsticc Art and you, or its business partners and associates.

Violations

Should any portion of this agreement be violated, a minimum fee of $100 applies per violation. Every day from the date of the original violation is considered a separate violation. I am entitled to 100% of all profits made from any violation of this agreement.

Terminology

“You”, “your”, “yours”, “client”, and “customer” refers to all persons who access this website, make a purchase, or otherwise agree to these terms.

“Physical product” refers to prints, mini prints, and anything sold by this website that can be sent to a physical address. “Digital product” refers to coloring pages, digital downloads, and anything sold by this website that can be delivered to a digital address. “Digital service” refers to commissions (custom artwork). “Subscription” refers to a service that is paid for monthly with rewards that change with each billing cycle.

Disclaimers

Actual physical product size that you receive may differ by 1-3mm. Due to the range of differences between monitors and printer settings, the colors displayed on your monitor may not accurately reflect the colors of the physical product you receive.

Subscriptions

By purchasing a Monthly Subscription, you agree to an initial and recurring Monthly Subscription fee at the then-current Monthly Subscription rate, and you accept responsibility for all recurring charges until you cancel your subscription. You may cancel or update your Monthly Subscription at any time, subject to the terms of my cancellation policy.

“Rewards” are the products, services, discount codes, and other bonuses you receive after each billing cycle is completed. Rewards are subject to change each month. In order to receive rewards, your automatic payment must be completed in full.

Refund and Exchange Policy

You retain the right to cancel any purchase prior to delivery or return a physical product for any reason. This section details certain situations in which you may or may not be entitled to a full or partial refund.

Digital Products & Services:

Once a digital product or service is delivered, the sale is considered final, and you are not entitled to a refund. You are not entitled to refunds or re-delivery for digital files that are lost or misplaced by you after the delivery is completed. If a digital product is paid for and not delivered, you will receive a full refund within 15 business days after cancellation of the delivery. You must pay in full for all digital products prior to delivery. Failure to do so may result in the destruction of files needed to complete and deliver the unpaid digital product. Digital files cannot be exchanged for another product or service.

Physical Products:

You may choose to return a physical product, for which you agree to pay all related shipping costs. Until a physical product return is complete (I receive the product), you are not entitled to any refund. If the physical product is returned with damage, you are entitled a partial refund or exchange at my discretion. If the returned physical product and all packaging (excluding the envelope required to deliveries and returns) is not damaged, you are entitled to a full refund or exchange for a product of equal or lesser value than the amount paid at time of purchase.

Commissions:

I retain the right to cancel any purchase prior to delivery for any reason. If I cancel a commission after payment is received, you are entitled to a partial refund based on the amount of work that was done. If no work was done, you are entitled to a full refund. If you cancel a commission after payment is received, you are not entitled to a refund.

Subscriptions:

Products that are delivered as part of the subscription service are not eligible for a refund or exchange. All subscription billing is final and non-refundable.

Intellectual Property Rights

Physical and Digital Products:

By purchasing a product, you agree that it will be used for personal use only. Commercial use of any products sold by this site is strictly prohibited. Distribution of digital products is strictly prohibited. Distribution of physical products for profit is prohibited. Products sold do not grant, represent or imply ownership of the artwork or contents included in said artwork. You may not intentionally alter a product or use parts of it in any other artwork or project unless otherwise specified in the product listing at the time of purchase.

You may post pictures or screenshots of any products you purchase, provided you leave all watermarks, signatures and other identifying marks unaltered, and a link to this website is clearly provided in the same post in a way that is accessible to all users who access the post.

You may create a derivative work of any Coloring Pages you purchase, provided you do not change or alter more than 10% of the original lineart.

Digital Services (Commissions):

Any content you provide to me for reference or use in artwork you purchase must be content you own or have the legal rights to reproduce. You agree to accept all legal responsibility for any intellectual property violations that you request. If you purchase a commission and knowingly request artwork that infringes on the rights of a 3rd party, you agree to pay all damages, court fees, and legal expenses that are incurred as a result.

By purchasing a commission, you grant Breadsticc Art the right to use the artwork for personal and commercial purposes, excluding the right to sell the product to other clients.

As the client, you are permitted to use the commissioned artwork for personal use. You are not permitted to alter the artwork or include it as part of any other derivative work. You are not permitted to use the artwork commercially.
